Digital India ACT

Crimes that take place on social media platforms like Twitter and Facebook as well as Metaverse are covered under India’s upcoming digital regulatory framework, the Digital India Act (DIA).

In addition, the DIA order also includes violations of content guidelines such as the dissemination of false information and incitement to violence by OTT platforms such as Netflix and Amazon Prime.

It was earlier reported that the proposed Digital India Act will oversee laws related to cybercrime and e-commerce. However, recent reports suggest that the government has expanded the scope of the DIA.

According to an ET report, the Ministry of Electronics and Information Technology (MeitY) is trying to replace the existing IT Act, 2000 by the winter session of Congress. The report adds that MeitY is “in a hurry” to pass the law on time and address specific guidelines for the safety of women and children online.

The Digital India Act covers all digital including social media platforms, OTT platforms, online applications and web 3 applications including metaverse and blockchain.

Regulators are looking at similar Internet laws around the world, such as Europe’s General Data Protection Regulation (GDPR) and laws in Singapore and Australia to develop Digital India laws. The government has also created a special committee to review the regulations from a technical and legal perspective.

It is worth noting that about 22 years have passed since the approval of the current information technology law, and the world of the Internet has undergone significant changes since its approval.

When the IT Act was first signed into law, there were no tech giants like Meta and Twitter, and Google was a small search engine. Lack of awareness about digital finance and other digital crimes, making it difficult to take action against digital crimes today.

More importantly, the Digital India initiative will ensure the safety of children and women while preventing the spread of misinformation.

The Digital India Act will regulate content on OTT platforms like Netflix and Amazon Prime to control the spread of misinformation. In this case, the government will issue “content guidelines” specifically for OTT platforms.

As far as such content is concerned, the DIA will be the supreme authority, asking the government OTT platforms to remove content that violates the guidelines.

Finally, the Digital India Act will try to bring some basic guidelines for technology like metaverse and blockchain, because there is a general consensus that the current IT Act is not enough to control the crime happening in this ecosystem.

For example, most crypto-related crimes are listed under the IT Act and other sections of the Indian Penal Code that deal with financial crimes. This has led to several crypto scams causing huge losses to Indians.
